Courts rule on pilots, immunity and trade secrets as a decree is endorsed and a suspect extradited
First and Second Circuit rulings, a Ninth Circuit stay decision, a consent decree, an extradition and two ICE enforcement encounters make up the federal justice docket.
- The First Circuit held that a maritime pilot association is not liable for a member pilot's actions unless it exercises control over the pilot's navigational duties, and that Northeast Marine Pilots, Inc. was not shown to exercise such control over Sean Bogus's duties. The court dismissed the negligence, indemnity and contribution claims against the association. m:…8635
- The First Circuit affirmed an order denying summary judgment based on qualified immunity, holding that the lower court erred by importing a subjective diligence standard and that genuine issues of material fact about the plaintiffs' job duties preclude summary judgment. Personal-capacity claims against government officials are not discharged by the PROMESA Plan of Adjustment. m:…2016
- The Ninth Circuit denied the government's motion to stay a district court's preliminary injunction pending appeal in National TPS Alliance v. Mullin, after the Court granted certiorari and vacated the Ninth Circuit's decision in Nat'l TPS All. v. Noem on October 5, 2026. The court also denied an administrative stay of at least 21 days and will set an expedited briefing schedule by separate order. m:…6907
- The Second Circuit reversed the district court's order granting Arcesium LLC's motion to dismiss, finding that SS&C's complaint sufficiently stated a claim for trade secret misappropriation under the DTSA. m:…8894
- A consent decree endorsed by the U.S. District Court for the Northern District of Ohio requires the owner of R & R Chinchilla Inc. to surrender over 300 remaining chinchillas, after roughly 800 animals were previously surrendered. m:…2057
- ICE says its Fugitive Operations Team arrested Walter Alexander Soto-Rodriguez in Alexandria, Virginia, on October 29, 2026. The agency describes him as a documented member of the MS-13 Gangsters Clique, and an immigration judge ordered him removed from the United States on May 8, 2025. Self-reported m:…6963
Appeals courts draw lines
The First Circuit affirmed the district court's partial grant of a motion to dismiss in the case against Northeast Marine Pilots, Inc. Under federal maritime law, a maritime pilot association is not liable for a member pilot's actions in piloting a vessel unless the association exercises control over the pilot's performance of his navigational duties. The court found that the complaint failed to plausibly allege that Northeast Marine Pilots, Inc. exercised control over Sean Bogus's navigational duties. The court dismissed the negligence, indemnity and contribution claims against the association, while denying the motion to dismiss as to the contract-based claims. m:…8635
In a second First Circuit decision, the court affirmed an order denying summary judgment based on qualified immunity. The court held that the lower court erred by importing a subjective diligence standard into the qualified immunity framework, and that genuine issues of material fact regarding the nature of the plaintiffs' job duties preclude summary judgment on qualified immunity. The court also held that personal-capacity claims against government officials are not discharged by the PROMESA Plan of Adjustment, and noted that the defendants failed to develop the argument that they were entitled to qualified immunity even assuming the plaintiffs' version of the facts. m:…2016
The Ninth Circuit denied the government's motion to stay a district court's preliminary injunction pending appeal in National TPS Alliance v. Mullin. The order followed the Court's decision on October 5, 2026, granting certiorari and vacating the Ninth Circuit's decision in Nat'l TPS All. v. Noem. The court also denied the government's request for an administrative stay of at least 21 days and will set an expedited briefing schedule on the merits by separate order. m:…6907
The Second Circuit reversed the district court's order granting Arcesium LLC's motion to dismiss. The court found that SS&C's complaint sufficiently stated a claim for trade secret misappropriation under the DTSA. It held that the district court engaged in impermissible fact-finding by crediting Arcesium's interpretation of facts over SS&C's. m:…8894
A decree and an extradition
Separately, the U.S. District Court for the Northern District of Ohio endorsed a consent decree between the United States and the owner of R & R Chinchilla Inc. The owner must surrender over 300 remaining chinchillas. The facility in Jenera, Ohio, previously surrendered roughly 800 chinchillas pursuant to a modified temporary restraining order. m:…2057
Mael Chemla, a 61-year-old national of the U.S., France and Israel, was extradited to the United States from Germany. He faces charges for his role in operating a mailing fraud scheme targeting U.S. consumers, and made his initial appearance in Miami federal court on November 2, 2026. He previously resided in Aventura, Florida. m:…6025
Enforcement encounters
In California, six ICE agents arrived at the Monterey Jail in Salinas on October 27, 2026, to request custody transfer of three suspected criminal illegal aliens, according to the agency. The suspects sought included Eduardo Castro-Lopez, Jose Luis Quinones and Angelina Ramirez-Sepulveda. Monterey County Sheriff Tina M. Nieto placed the jail on a three-hour lockdown during the operation, and no suspects were turned over to ICE during the lockdown period. By the day after the operation, Castro-Lopez had been released from custody and Quinones was no longer shown as being in custody, while Ramirez-Sepulveda remained in custody at the jail. m:…9627
In Virginia, an ICE Fugitive Operations Team arrested Walter Alexander Soto-Rodriguez, described by the agency as a documented member of the MS-13 Gangsters Clique, in Alexandria on October 29, 2026. During the arrest, Soto-Rodriguez attempted to flee in his vehicle, clipping an ICE vehicle and striking several parked vehicles before crashing into a guardrail. He had previously been ordered removed from the United States by an immigration judge on May 8, 2025. m:…6963
What is still unresolved
- The outcome of the trade-secret proceedings after the reversal of the dismissal
- The outcome of the TPS appeal after the expedited briefing schedule
- Whether ICE seeks further custody action for Angelina Ramirez-Sepulveda, who remained in custody after the Monterey operation
- The result of the prosecution of Mael Chemla, who faces charges for his role in operating a mailing fraud scheme
